2. Legal Framework
This policy has been drafted in accordance with the General Data Protection Regulation (EU 2016/679 — GDPR), the Belgian Law of July 30, 2018, on the protection of natural persons with regard to the processing of personal data, and the ePrivacy rules for electronic communications and cookies.

3. What data we process
Depending on your interaction with our website and services, we process the following categories of personal data:

3.1 Identification and contact information

• First and last name
• Email address
• Phone number (only for explicit contact requests)

3.2 Newsletter Information

• Date of birth
• Preferred language for communication (Dutch or French)
• Preferred categories (show type / genre)
• Preferred cities
• Source channel of the registration (e.g., homepage or exit pop-up)

3.3 Purchase-related data
In certain cases, we receive data from ticketing partners (such as Ticketmaster, BOZAR, In&Uit, Ticketmatic, SeeTickets, Kinepolis, and similar providers).

• This may include the following information:
  Identification information: last name, first name, email address, mailing address, and phone number
• Purchase details: show type, location, date, and amount of purchases
  We distinguish between two situations:
• Profile enrichment: Purchase data from existing newsletter contacts is used to segment communications more effectively, without requiring additional consent
• New contacts through ticket partners: If a ticket partner provides us with contact information for individuals who have given them consent for third-party marketing, we may contact those individuals directly. The ticket partner is responsible for recording and retaining that consent. We maintain internal records of which partner obtained the consent and on what date.

3.4 Technical and Analytical Data

• Noodzakelijke log-, fout- en prestatiegegevens, zoals het tijdstip, de bezochte route zonder queryparameters, browser- en apparaatgegevens en technische foutinformatie. Sentry is ingesteld zonder standaard-persoonsgegevens; gevoelige velden zoals e-mailadressen, tokens, cookies en verzoekinhoud worden waar technisch mogelijk vóór verzending verwijderd. Session Replay staat uit.

4. Purposes and Legal Bases
We process personal data only for specific purposes and on a valid legal basis:

• Responding to questions and requests — Legal basis: performance of pre-contractual measures or a contract
• Sending the newsletter — Legal basis: consent (opt-in), which may be withdrawn at any time
• Segmentation of the newsletter based on specified preferences (language, category, city) — Legal basis: consent
• Enriching contact profiles based on purchase history with ticket partners to improve the relevance of newsletter communications — Legal basis: legitimate interest
• Website Security and Fraud Prevention — Legal Basis: Legitimate Interest
• Technische fouten en prestatieproblemen detecteren en oplossen met Sentry — Rechtsgrond: gerechtvaardigd belang om de website betrouwbaar en veilig te houden
• Compliance with legal obligations (accounting, disputes) — Legal basis: legal obligation

5. Recipients and Disclosures
We share personal data exclusively with processors necessary for the provision of our services. All processors are contractually bound by a data processing agreement.

Our main processors are:

• Brevo (Sendinblue SAS, France) — email marketing platform and contact management
• Hostinger — web hosting provider
• Sanity — content management system
• Sentry (Functional Software, Inc.) — technische fout- en prestatiemonitoring, zonder Session Replay en met filtering van gevoelige velden
• Ticket partners — for purchase-related data as described in section 3.3

Voor advertentiemeting kunnen gehashte klantkenmerken en aankoopgegevens worden doorgestuurd naar Google Ads en Meta. Ticketmaster-aankopen gaan bij Meta uitsluitend naar een afzonderlijke meetdataset, los van de productiepixel en niet bestemd voor advertentie-optimalisatie of gecombineerde omzetmeting. De ruwe Ticketmaster-export wordt daarbij niet in het Music Hall Command Center bewaard. Alleen een niet-terugrekenbare orderreferentie en geaggregeerde verzendstatus worden in de afgeschermde analytics-opslag bijgehouden om dubbele uploads te voorkomen.

Bij doorgifte van persoonsgegevens buiten de Europese Economische Ruimte (EER) maken we gebruik van passende waarborgen, zoals de standaardcontractbepalingen van de Europese Commissie (SCCs), waar vereist.

6. Bewaartermijnen
We bewaren persoonsgegevens niet langer dan noodzakelijk voor het doel waarvoor ze werden verzameld, rekening houdend met wettelijke en contractuele verplichtingen.

6.1 Nieuwsbriefabonnees
Gegevens worden bewaard zolang de toestemming actief is. Na uitschrijving worden persoonsgegevens binnen 30 dagen verwijderd uit actieve systemen. Het e-mailadres wordt nadien maximaal 12 maanden bewaard als suppressielijst, uitsluitend om herhaalde ongewenste inschrijvingen te voorkomen.

6.2 Profielverrijking op basis van aankoophistoriek
Aankoopgegevens afkomstig van ticketpartners worden uitsluitend gebruikt voor segmentatiedoeleinden en bewaard zolang het nieuwsbriefcontact actief is. Bij uitschrijving worden ook deze gegevens verwijderd.

6.3 Contactaanvragen
Berichten en aanvragen worden maximaal 24 maanden bewaard na het laatste contact, tenzij een lopende overeenkomst of wettelijke verplichting een langere bewaring vereist.

6.4 Technische fout- en prestatiegegevens
Technische monitoringgegevens worden slechts gedurende de beperkte bewaartermijn van het Sentry-account bewaard en daarna verwijderd. We bewaren ze niet langer dan nodig om fouten te onderzoeken en de betrouwbaarheid van de website te verbeteren.

6.5 Wettelijke verplichtingen
Gegevens die noodzakelijk zijn voor boekhouding of geschillenbeslechting worden bewaard conform de toepasselijke wettelijke termijnen (doorgaans 7 jaar voor boekhoudkundige stukken).

7. Jouw rechten
Als betrokkene heb je onder de AVG de volgende rechten:

• Right of access: You can request to see what information we have about you
• Right to rectification: You can have inaccurate or incomplete information corrected
• Right to erasure (“right to be forgotten”): under certain conditions
• Right to restriction of processing: under specific circumstances
• Right to data portability: Requesting your data in a structured format
• Right to object: to processing based on legitimate interests
• Right to withdraw consent: not retroactive, at any time

You can exercise these rights by contacting privacy@musichall.be. We will process your request within 30 days. In the case of complex or multiple requests, this period may be extended by up to 2 months, provided you are notified.

If you believe your rights are not being respected, you have the right to file a complaint with the competent supervisory authority:

9. Cookies
Wij maken gebruik van cookies en vergelijkbare technologieën op onze website. Niet-noodzakelijke cookies (analytisch, marketing) worden pas geplaatst na jouw uitdrukkelijke toestemming via ons cookiebanner.

10. Beveiliging
We nemen passende technische en organisatorische maatregelen om persoonsgegevens te beschermen tegen ongeoorloofde toegang, verlies of misbruik. Dit omvat onder meer versleutelde verbindingen (HTTPS), toegangscontroles en regelmatige evaluatie van onze beveiligingspraktijken.

Bij een datalek dat een hoog risico inhoudt voor betrokkenen, zullen we je hiervan op de hoogte stellen conform de geldende wettelijke verplichtingen.

11. Wijzigingen
We kunnen dit beleid aanpassen bij wijzigingen in wetgeving, verwerkingen of gebruikte tools. De meest recente versie staat altijd op musichall.be/privacybeleid met bijgewerkte datum. Bij substantiële wijzigingen informeren we actieve nieuwsbriefabonnees via e-mail.
